Subrogation

The subrogation as a principle of insurance is a corollary of indemnity, and hence the Recovery is a corollary of adjusting. Information is much more easily gathered at the time of inspection and investigation immediately following the loss than later, when the trail has ‘gone cold’.

Lloyd’s Standard Form of Survey Report that we follow prompts our surveyor for information likely to be useful in any subsequent recovery action as well as recording what actions the claimant has taken to hold the carrier or other third party liable.

Our surveyors and adjusters understand the importance of ensuring that the prospects of making an eventual recovery from a responsible third party are maximized by ensuring that all the rights of the insurers are reserved by virtue of Section 78 of MIA and the related clause of “Duty of the Assured” whether in cargo or hull policies.
